| Summary, etc. | Le 30 juin 2020, l’Assemblée de la Province des Îles Loyauté en Nouvelle-Calédonie a adopté deux délibérations importantes et complémentaires, l’une sur les aires naturelles protégées et la seconde sur l’accès à la nature. Elles ont été élaborées conformément à l’esprit qui prévaut, depuis le début du projet, à la construction participative du droit de l’environnement de la Province des Îles Loyauté dans son Code de l’environnement (CEPIL). La prise en compte du contexte culturel local a été rendu possible par les mécanismes institutionnels qui libèrent, non sans difficulté, le droit calédonien du carcan juridique national. Les textes adoptés proposent un droit hybride dans leur contenu en maniant le principe de subsidiarité au profit des autorités locales, le respect de la hiérarchie des normes et la prise en compte des contraintes issues du droit international. |

| Summary, etc. | On June 30th of 2020, the Assembly of the Loyalty Islands Province in New-Caledonia adopted two important and complementary deliberations, one on protected natural areas and the second on the issue of access to nature. They were drawn up in accordance with the ambition that has prevailed since the beginning of the project. The environmental Code of the Loyalty Islands Province (CEPIL) is designed by a participative approach. Integrating the local cultural context was made possible by the institutional mechanisms that free New Caledonian law from the French national legal frame. The texts adopted propose a hybrid law in their content by handling the principle of subsidiarity to the benefit of local authorities, the respect of the hierarchy of norms and the constraints resulting from international law. |
