| Summary, etc. | Les procès environnementaux dans le domaine nucléaire sont relativement récents et donc encore peu nombreux. Leur typologie est extrêmement variée, du fait qu’aux effets, réels ou potentiels, des activités nucléaires sur l’environnement sont souvent mêlés des aspects sanitaires ou des considérations techniques liées à la sûreté des installations. Ils recouvrent également un large champ d’actions en justice, ayant une grande diversité de causes et de finalités.En matière de preuve et d’expertise, les victimes peuvent se heurter à de sérieuses difficultés tenant à la nécessité de disposer de connaissances et de moyens techniques spécialisés pour analyser les effets des rayonnements ionisants. C’est ainsi qu’a émergé, à la suite de l’accident de Tchernobyl, le besoin d’une expertise tierce, indépendante de celle exercée par des entités publiques. En outre, il existe, dans le domaine nucléaire, des moyens institutionnels d’accès à l’information qui permettent de faciliter les actions. A quoi s’ajoutent les « lettres de suite » de l’Autorité de sûreté nucléaire, dont le contenu relate les observations faites au cours des inspections, qu’elles donnent lieu ou pas au constat d’infractions pénales, et peuvent servir de supports à des actions, notamment de la part d’associations de protection de l’environnement. |

Thus, following the Chernobyl accident, the need for third-party expertise, independent of that carried out by public entities, emerged. Besides, in the nuclear field, there are institutional means of access to information that make it possible to facilitate actions. In addition, the « follow-up letters » of the Nuclear Safety Authority, content of which relates the observations made during inspections, whether or not they give rise to the finding of criminal offences, can serve as a support for actions, especially by environmental protection associations. |
