| Summary, etc. | Contentieux « reflet » de la résistance à l’intégration européenne, le contentieux généré par les périodes de chasse alimente le rôle du juge administratif de manière continue depuis plus de trente-cinq ans. Assis sur la directive 2009/147/ CE concernant la conservation des oiseaux sauvages, ce contentieux oppose régulièrement les institutions cynégétiques françaises, appuyées par les pouvoirs publics, à plusieurs associations de protection de la nature et pollue les relations entre l’ensemble de ces différents acteurs, qui partagent pourtant des centres d’intérêt communs. Après diverses péripéties, les instances cynégétiques françaises semblent avoir intégré la nécessité de répondre aux exigences européennes sur le seul terrain de la preuve scientifique. La volonté d’étendre à la chasse des oiseaux migrateurs le concept de gestion adaptative des espèces s’inscrit dans cette logique. Sa généralisation interroge cependant, tant d’un point de vue juridique que politique. |

| Summary, etc. | Litigation "reflecting" resistance to European integration, the litigation generated by hunting seasons has been playing a continuous role in the administrative courts for over thirty-five years. Based on Directive 2009/147/EC on the conservation of wild birds, this dispute regularly pits the French hunting authorities, supported by the public authorities, against a number of nature protection associations, and pollutes relations between all these different players, who nevertheless share common interests. After various ups and downs, French hunting authorities seem to have accepted the need to meet European requirements on the basis of scientific proof alone. The desire to extend the concept of adaptive species management to migratory bird hunting is in line with this logic. However, its generalization raises questions, both from a legal and a political point of view. |
