| Summary, etc. | Créée en 2008, plus de trente ans après la loi du 10 juillet 1976, que doit l’association L214 à la loi « sur la protection de la nature », dont l’article 9 est désormais codifié à l’article L. 214-1 du Code rural et de la pêche maritime ? En revenant sur les conditions du vote de deux dispositions phares de cette législation, ses articles 9 et 14, affirmant respectivement la sensibilité animale et la qualité pour agir des associations de protection animale, et en étudiant le contentieux impliquant l’association L214, tant du côté des demandeurs que des défendeurs, on découvre la complexité de l’héritage. L214 doit surtout sa visibilité à des stratégies médiatiques opérant sans respect du droit de propriété ou de la vie privée, mais déployées au service du droit des animaux. Au-delà des apparences d’une dénomination rendant hommage à la loi, la stratégie d’une association admettant l’illégalisme comme moyen d’action peut-elle se revendiquer de l’esprit de la loi de 1976 ? |

| Summary, etc. | Founded in 2008, more than 30 years after the Act passed on 10 July 1976, what does L214 owe to the "Nature Protection" Act, Article 9 of which is now codified in Article L. 214-1 of the French Rural and Maritime Fishing Code ? If we look back at the conditions under which two of the key provisions of this legislation were passed, articles 9 and 14, respectively affirming the sentience of animals and the procedural standing of animal protection associations, and if we study the litigation involving the L214 association, both on the plaintiffs’ and the defendants’ side, we discover the complexity of the legacy. L214 owes its visibility above all to media strategies that do not respect property rights or privacy, but are deployed in the service of animal protection. Beyond the appearances of a name paying homage to the law, can an association, endorsing a strategy which incorporates illegality as a means of action, claim to be consistent with the spirit of the 1976 Act ? |
