| Summary, etc. | The International Tribunal for the Law of the Sea (ITLOS) delivered its first climate-change related advisory opinion on 21 May 2024. The advisory opinion, requested to the Tribunal by the Commission of Small Island States on Climate Change and International Law (COSIS), addressed several issues regarding the enforcement of the United Nations Convention on the Law of the Sea (UNCLOS) in the context of climate change, including the interaction between UNCLOS and the global climate change regime, as well as the specific obligations of States to reduce greenhouse gas (GHG) emissions. This article questions the compensation for climate change damage under international law, and in particular the (non) taking into account, in the opinion delivered by the Tribunal, of aspects related to compensation for the damage. This article attempts to provide a different approach which, if it had been undertaken by the Tribunal, could have opened up interesting prospects to consolidate a real regime of international liability for environmental damages resulting from impacts of climate change. |

| Summary, etc. | Le Tribunal international du droit de la mer (TIDM) a rendu le 21 mai 2024 son premier avis sur les questions posées à titre consultatif par la Commission des petits États insulaires sur le changement climatique et le droit international (COSIS). L’avis consultatif aborde plusieurs questions clés concernant l’application de la Convention des Nations unies sur le droit de la mer (CNUDM) dans le contexte du changement climatique, notamment l’interaction entre la CNUDM et le régime international sur le changement climatique, et les obligations spécifiques des États de réduire les émissions de gaz à effet de serre (GES). Cet article s’interroge sur la réparation des dommages climatiques en droit international, et notamment sur la (non) prise en compte, dans l’avis rendu par le Tribunal, des aspects liés à la réparation du dommage. Le présent article tente de proposer une approche différente qui, si elle avait été entreprise par le Tribunal, aurait pu ouvrir des perspectives intéressantes pour consolider un véritable régime de responsabilité internationale pour les dommages environnementaux liés au changement climatique. |
