| Summary, etc. | Longtemps contenu dans sa fonction de production alimentaire et de support de constructions, le sol est désormais mobilisé au service de la politique climatique. À la fois « puits » et « source », il occupe une place centrale dans le cycle du carbone et justifie l’intérêt que lui porte le droit international. À la croisée des Conventions sur le climat, sur la biodiversité et sur la désertification, il trouve un nouveau support de protection afin de pérenniser le service écosystémique particulier qu’est la séquestration du carbone. L’efficacité de ce service impose cependant de gérer le sol de façon durable, en évitant sa disparition du fait de son artificialisation ou de son érosion et en renforçant sa capacité de stockage par un soutien à la diversification des activités agricoles. Le droit de l’Union européenne, via les MAEC, permet d’orienter ces activités pour satisfaire cet objectif para-agricole et rémunérer un nouveau service environnemental. |

| Summary, etc. | Long considered in its function of food production and building and construction basement, the soil is now mobilized for the climate policy. “Carbon sink” and “carbon source” into one, it occupies a central position in the terrestrial carbon cycle and justifies an interest of international law. At the crossroads of Conventions on Climate, Biodiversity and Desertification, the soil finds a new tool for protection in order to sustain the particular ecosystem service which is carbon sequestration. The efficiency of this service, however, requires sustainable management of the soil, avoiding its disappearance though artificialization or erosion and strengthening its storage capacity by supporting diversification of agricultural activities. European Union law, via the AECM, allows to guide these activities to meet this para-agricultural goal and to pay for a new environmental service. |
