| Summary, etc. | Cette étude traite des relations entre l’État et les jardins partagés ou collectifs. Entendus comme une activité de jardinage commune sur une parcelle donnée qui vise à créer du lien social et à préserver l’environnement, les jardins s’apparentent à des communs au sens économique. L’idée n’est pas d’observer directement ces structures mais plutôt leur régime juridique. En effet, regarder le droit c’est appréhender la manière dont l’État interagit avec ce type de communs. L’analyse conduira ainsi à démontrer que les jardins sont des communs réalisés par l’État. Plus précisément, l’État fournit la ressource partagée nécessaire à l’établissement d’un commun tout en garantissant une bonne répartition des droits d’usage. L’État est donc un support qui permet aux jardins de gagner en pérennité tandis que ces derniers offrent au premier un nouveau mode d’action qui se caractérise par son efficacité et son ouverture aux individus. |

| Summary, etc. | This study deals with relations between the State and shared or community gardens. Defined as a common gardening activity on an allotment which contributes to create social bond and preserve environment, these structures tend to match the concept of commons in its economic meaning. The main goal is not to directly observe the garden but more their legal regime because this leads to apprehend the interactions between the State and commons. This paper demonstrates the State helps gardens to be institutionalized as commons. More precisely, the State provides a shared resource that commons need while ensuring an appropriate distribution of rights of use. Finally, the State is a support which enables gardens to be more sustainable, but also, gardens offer a new modality of action which can be characterized by its efficiency and its openness towards people. |
