| Summary, etc. | Dans la définition des communs par Elinor Ostrom, la jouissance partagée du commun est l’une de ses caractéristiques principales. Pourtant, la jouissance partagée d’un bien foncier n’a rien d’une évidence en droit civil français. En effet, le modèle de la relation aux biens s’est construit sur la propriété exclusive et absolue. Il semblerait cependant qu’avec les droits réels de jouissance spéciale, il soit désormais possible, pour un propriétaire, de librement distribuer les utilités de son bien entre des personnes différentes. La propriété, bien qu’exclusive, prendrait alors une teinte inclusive. Surtout, ce partage d’utilités pourrait s’inscrire dans une logique de préservation environnementale du commun : d’abord en paralysant l’absolutisme de la propriété en limitant le pouvoir du propriétaire sur son bien ; ensuite en retirant de facto, durant le temps du partage, le bien du commerce juridique. |

| Summary, etc. | In Elinor Ostrom’s definition of the commons, shared use of the commons is one of its main characteristics. However, the shared use of a piece of land is not self-evident in French civil law. Indeed, the model of the relation to property was built on exclusive and absolute ownership. It would seem, nevertheless, that with the real rights of special use, it is now possible for an owner to freely distribute the uses of his property among several people. Ownership, although exclusive, would then take on an inclusive tone. Above all, this sharing of utilities could be part of a logic of environmental preservation of the common good: first, by paralyzing the absolutism of ownership by limiting the owner’s power over his property; second, by de facto withdrawing, during the time of sharing, the property from legal trade. |
