Summary, etc. Accoler les termes commun et Union européenne évoque irrésistiblement le marché éponyme. Pourtant, un commun peut en cacher un autre. La protection de la biodiversité ne serait-elle pas constitutive d’un patrimoine commun ? Question épineuse s’il en est. De quel patrimoine parle-t-on ? Dans un sens figuré, l’accent est mis sur la conservation et la transmission de biens culturels et naturels. C’est cette seconde conception qui a fait florès en droit de l’environnement. Deux motifs, l’un exogène, l’autre endogène, permettent d’esquisser l’hypothèse selon laquelle l’UE serait un laboratoire juridique de la patrimonialisation de la biodiversité. Tout d’abord, le droit de l’UE est imprégné par plusieurs traités sur la conservation des espèces et des habitats qui érigent la biodiversité en patrimoine commun de l’humanité. Ensuite, l’examen du droit de l’UE « endogène » fait apparaître des indices d’une patrimonialisation implicite. Cependant, cette patrimonialisation est faite pour ainsi dire sans le savoir à la manière de M. Jourdain. C’est pourquoi cette démarche demeure incontestablement inachevée. Il apparaît qu’une proclamation de la patrimonialisation est opérée sous l’impulsion des jurislateurs de l’UE. Toutefois, au-delà de cette reconnaissance quelque peu incantatoire, des mesures de conservation ont été adoptées afin de garantir la transmission de ce patrimoine naturel.

Summary, etc. Joining the terms common and European Union irresistibly evokes the eponymous market. Yet, one common can hide another. Wouldn’t protecting biodiversity constitute a common heritage? This is a thorny question. What heritage are we talking about? Figuratively, the emphasis is on the conservation and transmission of cultural and natural property. It is this second concept that has made the world of environmental law. There are two exogenous and endogenous reasons for the hypothesis that the EU is a legal laboratory for the heritage of biodiversity. First, EU law is permeated by several treaties on the conservation of species and habitats that make biodiversity a common heritage of humanity. Second, an examination of "endogenous" EU law reveals evidence of implicit inheritance. However, this heritage is done almost without knowing it in the manner of Mr. Jourdain. This is why this process remains unquestionably incomplete. It appears that a proclamation of the patrimonialization is carried out under the impulse of the EU jurislateurs. However, beyond this somewhat incantatory recognition, conservation measures have been adopted to guarantee the transmission of this natural heritage.
