| Summary, etc. | À l’image du double sens de l’expression « étude d’impact » (processus et document de rapportage), deux réalités cohabitent au cœur même de l’évaluation environnementale : celle de la prise en compte réelle de l’environnement dans la conception d’un plan, programme ou projet et la manière dont celle-ci est mise en récit par celui qui la rédige, dans un temps précis de la procédure. Involontairement orchestrée par le droit, cette dualité est à l’origine de nombreux quiproquos et glissements qu’il est essentiel de décrypter. Parce que le droit impose le récit fictionnel et non la réalité comme référence dans le processus préparant la décision, il donne finalement au maître d’ouvrage, aidé de ses prestataires rédacteurs du rapport environnemental le pouvoir décisif, maîtrisé ou non, de réécrire l’histoire à son profit. Car c’est bien le défaut et non l’excès d’évaluation environnementale qui bride aujourd’hui nos capacités sociétales à intégrer efficacement l’environnement. Si le droit ne peut suffire, il doit y contribuer en conscience. |

| Summary, etc. | In french law, double meaning of the expression “impact assessment” (process and reporting document), shows two realities which coexist at the very heart of environmental assessment : the real consideration of the environment in the design of a plan, program or project and the way in which it is told by the person who writes the report, in a specific time of the procedure. Involuntarily orchestrated by the law, this duality is at the origin of numerous misunderstandings and slippages which it is essential to decipher. Because the law imposes the fictional story and not reality as a reference in the process preparing the decision, it ultimately gives the project owner, helped by his service providers who draft the environmental report, the decisive power, controlled or not, to rewrite the story for his benefit. Because it is indeed the defect and not the excess of environmental assessment which today limits our societal capacities to effectively integrate the environment. If the law cannot suffice, it must consciously contribute to it. |
