Summary, etc. | Le droit constitue un savoir en proie à des divisions disciplinaires, en ce sens qu’il est divisé en différentes disciplines. La division droit public – droit privé constitue à ce titre la summa divisio du champ juridique. Cette division disciplinaire se répercute sur la recherche en droit : à la division disciplinaire du savoir correspond une division disciplinaire de la recherche sur ce savoir. Pourtant, certains sujets de thèse ne se rattachent exclusivement ni à l’un ni à l’autre de ces champs disciplinaires : ils sont « transversaux ». La recherche juridique se heurte alors à des problèmes méthodologiques trouvant leurs racines dans la division disciplinaire du savoir juridique. En partant d’une expérience de recherche sur un sujet transversal, il est proposé une réflexion sur la méthode d’appréhension de la division disciplinaire droit public – droit privé dans la réalisation de la recherche juridique. |

Summary, etc. | Law is a disciplined knowledge, in the sense that it is divided into different disciplines. In French law, the public law – private law division is the summa divisio of the legal field. This disciplinary division has repercussions on legal research: the disciplinary division of knowledge corresponds to a disciplinary division of research on this knowledge. However, some thesis topics do not belong to either of these disciplinary fields: they are « cross-cutting ». Legal research then comes up against methodological problems resulting from the disciplinary division of legal knowledge. From a research experience on a transversal subject, this contribution suggests a reflection on the method of apprehending the disciplinary division of public law - private law in the performance of legal research. |
