| Summary, etc. | Le raisonnement conceptuel est aujourd’hui si enraciné dans notre méthodologie qu’il apparaît comme consubstantiel au raisonnement juridique. Sa place a pourtant fait l’objet, au tournant du xxe siècle, d’une longue et importante controverse justifiée par les importantes limites de ce mode de pensée. Si ce débat s’est clos, en France, par l’adoption d’une position médiane intégrant ces limites, cette position a graduellement été perdue de vue, ce qui a conduit à la réutilisation de l’appareil intellectuel propre à ce mode raisonnement sans conscience de ses faiblesses, ni même de ses fondements originaux. A cet égard, la période contemporaine peut être qualifiée de néo-conceptualiste. |

| Summary, etc. | Conceptualistic reasoning is so entrenched in French legal methodology that it appears inherent to legal reasoning. Its merits have yet been thoroughly challenged at the turn of the xxth century in light of its substantial limits. While the debate led in France at the time to the adoption of a balanced position respectful of those limits, this position was gradually forgotten. This caused the revival of the intellectual tools inherent to that mode of reasoning, without the conscience of its limits, nor of its original theoretical foundations. In this respect, the modern period can be labelled as neo-conceptualistic. |
