| Summary, etc. | Le droit nazi n’a pas débuté qu’en 1933 avec l’arrivée d’Hitler au pouvoir. Il possède des fondements historiques reposant sur la négation de ce qu’il est aujourd’hui convenu d’appeler les principes généraux du droit. Les responsables des exécutions de masse étaient souvent des juristes formés dans des universités prestigieuses. Les dogmes juridiques nazis reposaient sur l’antisémitisme et la hiérarchie des races. Ils incluaient le droit de tuer. Le sort des armes a fait que ces principes juridiques ont influencé le droit français pendant la période du régime de Vichy. À titre de comparaison, on peut évoquer la question de l’existence du droit soviétique, issu de l’autre régime totalitaire du xxe siècle. |

| Summary, etc. | Nazi law didn’t start until 1933 with Hitler’s rise to power. It has historical foundations based on the negation of what today is called general principles of law. Those responsible for the mass executions were often lawyers trained in prestigious german universities. Nazi legal dogmas were based on anti-Semitism and the hierarchy of races. They included the right to kill. The fate of arms meants that these legal principles influenced french law during the period of the Vichy regime. By way of comparison, we can evoke the question of the existence of Soviet law, which emerged from the other totalitarian regime of the 20th century. |
