| Summary, etc. | Probabilité et loi ne sont pas étrangères l’une à l’autre. Le concept de probabilité épistémique impose, en effet, de faire la différence entre ce qui cause l’apparition d’une chose et ce qui nous informe qu’elle est apparue. L’un des mathématiciens du siècle, Jacques Bernoulli, né à Bâle en 1654, a travaillé sur la probabilité empirique, laquelle prend comme base de réflexion des faits. Son traité posthume, consacré théorie de la probabilité et intitulé l’art de conjecturer, paraît en 1713, propose d’appliquer l’art de conjecturer à la vie civile, morale et politique. Ce fut là une grande originalité, laquelle mérite aujourd’hui toute l’attention de l’historien du droit. |

The concept of epistemic probability requires, in effect, to differentiate between what causes the appearance of a thing and what informs us that it has appeared. One of the mathematicians of the century, Jacques Bernoulli, born in Basel in 1654, worked on empirical probability, which takes as a basis for thinking about the facts. His posthumous treatise, devoted theory of probability and entitled the art of conjecturing, appeared in 1713. proposes to apply the art of conjecturing to civil, moral and political life. This was a great originality, which today deserves the full attention of the legal historian. |
