En droit islamique, le dol consiste en une tromperie qui vise à conduire l’autre partie à conclure le contrat sur une fausse conviction, comme c’est le cas en droit positif. Le dol est constitué de deux éléments cumulatifs : matériel et subjectif. La doctrine islamique est plus abondante et plus riche en termes d’application car la loi islamique faite par Dieu, est valable pour tout moment et lieu. |

| Summary, etc. | This study deals with the relationship between Muslim law and positive law in terms of fraud. In Islamic law, fraud consists of deception, which aims to lead the other party to conclude the contract on a false conviction ; as is the case in positive law. Moreover, fraud is made up of two cumulative elements : material and subjective. Evidently, Islamic doctrine is more abundant and more affluent in terms of application because it is made by Almighty God and is valid for every time and place. |
