| Summary, etc. | La charte de la diversité en entreprise, norme ayant pour vocation de lutter contre les discriminations dans le monde du travail, interpelle. Ses propriétés constituent une curiosité normative : à la différence des normes traditionnelles en droit, elle relève du droit souple et du domaine du juridiquement souhaitable. Sa justification interroge aussi. En effet, les fondements dogmatiques du droit se révèlent inappropriés à la nature même de cette charte. C’est donc à travers un fondement calqué sur le modèle de l’utilitarisme qu’il convient d’établir la justification de cette norme qui constitue, au final, un outil de légitimité pour l’employeur. |

| Summary, etc. | The charter of diversity in corporation is a standard amed to fight against discrimination in the corporate. Its properties consitute a curiosity from a noramtive point of view. Unlike usual norms in law, it’s a soft law and in the domain of the legally desirable. Also, its foundation rises some questions. Indeed, the dogmatic foundations of law are inappropriate to the nature of this charter. It is therefore through a foundation modeled on the utilitarianism that the justification for this standard should be established, which ultimately constitutes a tool of legitimacy for the employer. |
