| Summary, etc. | Depuis plusieurs années, une catégorie particulière d’acteurs économiques a émergé, spéculant sur l’endettement. Ces fonds d’investissement ont la spécificité de racheter à des banques des créances à très bas prix compte tenu de leur faible probabilité de recouvrement, et d’en poursuivre sans relâche le paiement auprès des débiteurs. Leur stratégie de recouvrement très offensive les a fait connaître par l’opinion publique et leur a valu d’être péjorativement qualifiés de « vautours ». Encore peu connus des juristes, ces créanciers atypiques et leur manière de faire valoir leur droit de créance méritent d’être étudiés de plus près. La présente étude propose une analyse des pratiques de recouvrement de ces fonds spéculatifs et des moyens juridiques de les réguler. |

These hedge funds buy a huge amount of doubtful debts for cheap, and aim at getting paid to the last cent. In the public opinion, they earned the nickname « vulture funds » because of their agressive debt collecting strategy. These particular creditors, the way they realize their right and the legal means to regulate them deserve to be better known by scholars. |
