Summary, etc. | L’indivision a toujours été pensée comme nécessairement provisoire. C’est la raison pour laquelle le législateur a prévu à l’article 815 du Code civil le droit pour les indivisaires de demander le partage à tout moment. Ce droit au partage, présenté comme presque « absolu » par la doctrine, est pourtant assorti de deux dérogations : la décision de justice et la convention des héritiers. Il est ainsi possible de surseoir au partage, que ce sursis soit décidé par un juge ou convenu par les indivisaires. À partir du moment où l’article 815 ne le prévoit pas, le testament ne peut surseoir au partage et ainsi imposer le maintien dans l’indivision pendant une certaine durée. Pourtant, il ressort de l’étude du droit romain, de l’Ancien droit, de la doctrine récente et de la jurisprudence, qu’aucune bonne raison ne justifie cette interdiction. Au contraire, il est possible d’établir un certain nombre d’arguments allant dans le sens d’une autorisation pour le testateur de maintenir l’indivision dans le temps. C’est l’idée soutenue dans cet article, idée prenant forme dans l’établissement d’un régime juridique propre à cette autorisation proposée au sein d’un nouvel article 900-9 du Code civil. |

Summary, etc. | Joint ownership has always been thought as something temporary. That is why undivided co-owners may demand the division at any time. This right to a division, considered absolute by the doctrine of case-law, has two exemptions : court decision and successors’s agreement. Therefore, this is possible to stay the proceedings, by the judge or undivided co-owners. Because article 815 of the civil code does not provide for it, the testament cannot postpone the sharing and impose the maintenance of the joint ownership for a certain period of time. However, the study of Roman law, ancient law, and recent doctrine and jurisprudence depicts that there is no good reason for this prohibition. On the contrary, it is possible to establish a number of arguments in favour of allowing the testator to maintain the joint ownership over time. This is the idea widely supported in this article, an idea that takes shape in the establishment of a legal regime specific to this proposed authorization within a new article 909-9 of the civil code. |
