| Summary, etc. | De nos jours, être parent à l’adolescence demeure plongé au cœur d’une ambiguïté sociale et juridique, en raison du double statut du parent encore mineur, ou du mineur devenu parent. Cette parentalité précoce fait face à son lot de difficultés socio-familiales, et, sur le plan juridique, le double statut de parent-enfant est d’une conciliation difficile, plus particulièrement à l’intersection de l’adoption et de la protection de la jeunesse. En effet, le Directeur de la protection de la jeunesse (DPJ) doit de prendre tous les moyens raisonnables pour faciliter l’adoption s’il considère que cette mesure est « la plus susceptible d’assurer l’intérêt de l’enfant et le respect de ses droits »*. Or, l’adoption emporte des conséquences irréversibles tant pour l’enfant adopté que son parent biologique. Lorsque ce dernier est aussi un enfant au sens de la Loi, des balises doivent être posées pour mieux prendre en compte tant l’intérêt de l’enfant parent que de l’enfant à adopter. |

| Summary, etc. | Up to this day, adolescent parenthood has been at the heart of a social and legal ambiguity due to the double status of the parent still a minor, or of the minor becoming parent. Early parenthood proves to be especially difficult on both the social and familial levels, and, legally speaking, balancing the double status of a child-parent is challenging, most notably at the intersection of adoption and child protection policies. Indeed, the Director of Youth Protection (DYP) must take all reasonable means to facilitate adoption if he considers this measure to be « the most likely to ensure the interest of children and the respect their rights ». However, adoption has irreversible consequences both for the adopted child and his biological parent. When the latter is also a child within the meaning of the law, further regulation is needed to better account for both the interest of the child parent and the to-be-adopted child. |
