| Summary, etc. | À la vingt quatrième année de son application, l’AUPSRVE est pour l’instant le plus vieux dans le corpus normatif de l’OHADA à n’avoir pas fait l’objet de modification. Il n’empêche cependant qu’il a été au devant de l’actualité pendant toutes ces années. Cette actualité l’a été par procuration au plan législatif et véritablement assumée par la CCJA au plan jurisprudentiel. Les difficultés ayant ponctué l’actualité visée sont nombreuses et ont atteint un stade de maturation qui appellent désormais une réforme urgente pour leur donner des solutions. Heureusement, elle est annoncée et en cours, et la présente réflexion est une contribution dans ce sens. |

| Summary, etc. | In its twenty-fourth year of application, the Uniform Act on Simplified Recovery Procedure is for the moment the oldest of the OHADA Uniform Acts which has not been amended. However, this has not stopped it to be at the forefront of discussions within all these years. These discussions have been by proxy at the legislative level and assumed by the CCJA in its rulings in the different cases which come before it. The difficulties raised within these discussions are many and have reached a stage of maturity which now calls for an urgent reform in order to provide solutions. Fortunately it is previewed and in progress and the present reflection is a contribution in this direction. |
