| Summary, etc. | L’article 1148 du Code civil pose le principe d’une sphère d’autonomie intangible applicable à toute personne incapable de contracter. Indépendamment de son statut et/ou de sa mesure de protection, la personne mineure ou majeure dispose de la possibilité de conclure seul(e) des « actes courants ». Sous l’apparence d’une unicité de régime, il existe de nombreuses différences et inégalités entre les mineurs non émancipés et les majeurs protégés dont l’autonomie du quotidien n’est pas identique. L’article interroge l’unification juridique mise en œuvre par le législateur lors de la réforme du droit des obligations. La première partie propose une analyse des critères ou indices jurisprudentiels s’appliquant aux actes courants conclus seuls par les mineurs non émancipés et les majeurs protégés. La seconde partie est consacrée aux fondements qui semblent avoir justifié l’unité du régime et dont certains invitent à la prudence. |

| Summary, etc. | Article 1148 of the Civil Code establishes an intangible sphere of autonomy applicable to any person incapable of contracting. Regardless of his status and/or protection measure, the minor or adult may conclude the « current acts by himself ». Under the guise of a single regime, unemancipated minors and protected adults are treated very unevenly as for daily autonomy. The article questions the legal unification implemented by the legislator through the law of obligations reform. The first part proposes an analysis of the criteria or jurisprudential indices applying to routine acts concluded by unemancipated minors and protected adults by themselves. The second part presents how this unique regime was built, and offers a nuanced vision of it. |
