| Summary, etc. | Le réquisitoire introductif d’instance est un acte important de la procédure pénale au Cameroun en ce qu’il permet de mettre en œuvre l’information judiciaire. Les options offertes au juge d’instruction lorsqu’il le reçoit sont cependant perturbatrices et amènent à se demander si à travers cet acte le parquet a toujours la certitude, dans les conditions qu’il détermine, de mettre en marche son office. En dépit des marges de manœuvre reconnues à la juridiction d’instruction, il apparaît que le réquisitoire introductif d’instance, clé double et clé boussole tout à la fois, reste l’acte sans lequel la saisine en toute hypothèse du juge d’instruction, de même que la configuration initiale son office, est impossible. Mais, les possibilités d’intervention à l’information qu’il ouvre au parquet sont tellement nombreuses qu’elles remettent au goût du jour la question d’un juge d’instruction véritablement indépendant au Cameroun. |

| Summary, etc. | The holding charge is an important act of the Criminal Procedure in Cameroon in that it permits the initiation of preliminary inquiry. The options opened to the Examining Magistrate when he receives it, are however disturbing and lead to questioning whether through this act the Legal Department always have certainty, under the conditions it determines, to trigger preliminary inquiry. Despite the room for maneuver granted to this investigation jurisdiction, it appears that the holding charge, a double sided and compass key at the same time, remains the act without which referral in all hypotheses to the Examining Magistrate as well as the initial configuration of his office, is impossible. But the possibilities of intervention in the preliminary inquiry that it opens to the Legal Department are so numerous that they throw up the question of a truly independent Examining Magistrate in Cameroon. |
