| Summary, etc. | Cet article a pour objet l’analyse de la pratique, par la Cour de cassation, de la possibilité de casser sans renvoi pour bonne administration de la justice qui a été introduite par la loi n° 2016-1547 du 18 novembre 2016. L’étude s’appuie sur un échantillon de 112 décisions afin de dresser une classification des arrêts rendus sur le fondement de l’article L. 411-3 alinéa 2 du Code de l’organisation judiciaire. Sont ensuite étudiées les conséquences de l’usage de cette technique. L’usage de la cassation sans renvoi pour bonne administration de la justice produit des effets similaires à la pratique antérieure, mais révèle aussi une transformation de l’office du juge de cassation qui n’est pas sans risque. |

| Summary, etc. | The paper analyses the use by the French Cour de cassation (mostly called to rule on whether the rules of law have been correctly applied, based on the facts sovereignly assessed in the decisions of the lower courts) of a new ground to refuse a retrial : overturning without referral for proper administration of justice. This procedure was introduced by Law 2016-1547 of 18 November 2016. This study is based on a sample of 112 decisions, drawing up a classification of rulings issued on the basis of article L. 411-3 paragraph 2 of the French Code de l’organisation judiciaire. Then the article focuses on the consequences of overturning without referral for the proper administration of justice. This produces similar effects to the previous case-law, but it also reveals a shift in the role of the French Cour de cassation that could pose some risks. |
