| Summary, etc. | En apparence, la rencontre entre la théorie du service public et la théorie des Critical Legal studies pourrait paraître artificielle, mais il convient toujours de se méfier des apparences. Alors que la première s’est développée en France au début du xxe siècle, la seconde est née aux États-Unis, au sein d’un mouvement académique, à la fin des années 1970. Pourtant, à y regarder de plus près, certains éléments de chacune de ces deux théories méritent d’être analysés en miroir, non pas côte à côte, mais les uns face aux autres. Aujourd’hui, la théorie de service publique résisterait-elle au « test » des Critical Legal Studies ? Est-il utile de confronter ces deux théories et si oui dans quelle mesure ? Cette étude, croisant ces deux théories, permet de réinterroger leurs fonctions dans nos sociétés contemporaines, enserrées dans des économies mondialisées et des politiques libérales, face auxquelles elles tentent de s’adapter ou de s’opposer avec plus ou moins de succès. |

| Summary, etc. | On the face of it, the meeting of public service theory and Critical Legal Studies might seem artificial, but we should always be wary of appearances. While the former developed in France at the beginning of the twentieth century, the latter was born in the United States, within an academic movement, at the end of the 1970s. However, on closer examination, certain elements of each of these two theories deserve to be analysed in mirror image, not side by side, but in relation to each other. Today, would public service theory stand the “test” of Critical Legal Studies ? Is it useful to compare these two theories, and if so, to what extent ? This study cross-references these two theories, enabling us to re-examine their functions in our contemporary societies, which are caught up in globalised economies and liberal policies, to which they are trying to adapt or oppose with varying degrees of success. |
