| Summary, etc. | In 1957, when the Treaty of Rome was signed, four out of six of the original member states were colonial powers. This article uses archival material from the Treaty of Rome negotiations to interrogate ways in which the colonial politics of the time shaped the drafting of legal categories describing individuals : those of peoples, inhabitants and workers. As the Treaty of Rome « associated » colonized territories to the EEC, this article shows how the treaty simultaneously arranged its legal categories to exclude individuals who lived in colonized territories from legal benefits and representation. The historical and contextual methodology used in this article allows us to critically re-investigate the origins of EU law. Such a methodology can serve as the overture to a theory of how colonialism shaped not just the law in territories that were colonized, but the laws of Europe too. As such this article aims to develop an immanent critique of what colonialism did to EU law. |

| Summary, etc. | En 1957, lors de la signature du Traité de Rome, quatre des six États membres fondateurs étaient des puissances coloniales. Cet article utilise les archives des négociations du Traité de Rome pour interroger la manière dont les politiques coloniales de l’époque ont façonné l’élaboration des catégories juridiques décrivant les individus : celles de peuple, d’habitant et de travailleur. Alors que le Traité de Rome « associait » les territoires colonisés à la CEE, cet article montre comment le traité a ordonné ses catégories juridiques de façon à priver les individus qui vivaient dans les territoires colonisés de droits et de représentation. La méthodologie historique et contextuelle utilisée dans cet article permet de réexaminer de manière critique les origines du droit de l’UE. Elle peut servir d’ouverture à une théorie sur la manière dont le colonialisme a façonné non seulement le droit des territoires colonisés, mais aussi le droit européen. En tant que tel, cet article vise à développer une critique immanente de ce que le colonialisme a fait au droit de l’UE. |
