| Summary, etc. | La présente contribution étudie les décisions qui ont pu être adoptées par la Cour européenne des droits de l’homme vis-à-vis des juridictions constitutionnelles nationales de différents États. Nous passerons en revue des arrêts dans lesquels la Cour s’est prononcée sur la procédure suivie devant les cours constitutionnelles, sur la nécessité d’épuiser le recours constitutionnel avant de la saisir, mais également sur le contrôle, par la Cour européenne, de l’interprétation qui est faite par les cours constitutionnelles des dispositions constitutionnelles et de la Convention ainsi que de la façon dont celles-ci exécutent le test de proportionnalité. |

| Summary, etc. | This contribution focuses on the way the European Court of Human Rights perceives national constitutional courts. We will review and highlight the position of the European Court of Human Rights on the existing procedures applicable to national constitutional courts, the necessity – or lack thereof – to lodge a constitutional appeal in order to exhaust all domestic remedies, and the way the European Court monitors the interpretation of constitutional and conventional rights, as well as the correct application of the proportionality test by constitutional courts. |
