À cette occasion, la Cour de justice précisa son interprétation du seuil de gravité requis pour relever de l’interdiction de traitements inhumains et dégradants consacrée à l’article 4 de la Charte des droits fondamentaux de l’Union européenne. Au détour de cette problématique furent également abordées des questions centrales relatives à la protection des droits fondamentaux par l’Union européenne, en particulier liées au champ d’application de la Charte et à sa relation avec les standards de la Convention européenne des droits de l’homme. In this context, the Court of Justice clarified its interpretation of the threshold of severity required to qualify as a violation of the prohibition of inhuman and degrading treatment enshrined in Article 4 of the Charter of Fundamental Rights of the European Union. Alongside this issue, fundamental questions regarding the protection of human rights by the European Union were also discussed, particularly concerning the scope of application of the Charter and its relationship with the standards set by the European Convention on Human Rights. This commentary aims to provide a critical analysis of the responses given and the questions raised by this ruling. |
