| Summary, etc. | Le mariage jouit de la faveur du droit. Tout mariage est indissoluble et seule la fin de celui-ci permet de passer à de secondes noces. Dans le cas contraire, tout consentement est naturellement suffisant mais juridiquement inefficace. Or, les facultés du 11 février 2013 concédées à la Rote romaine par le pape Benoît XVI remettent en cause ce principe : il est possible de reconnaître des secondes noces malgré l’éventuel empêchement de lien préexistant. La position catholique rejoindrait par cet apax juridique la position orthodoxe. |

Otherwise any consent is of course sufficient but legally ineffective.
