Summary, etc. | Cet article propose de montrer la complémentarité substantielle entre la « solidarité de droit » et la « solidarité d’engagement » à travers l’exemple des deux réclamations collectives introduites dans le cadre du Protocole additionnel à la Charte sociale européenne. Il décrit le processus par lequel les organisations internationales non gouvernementales ( oing) conduisent l’État à rendre conformes leurs politiques à la Charte sociale européenne révisée du Conseil de l’Europe. L’accent plus spécifique est mis sur deux réclamations collectives adressées par le Comité européen d’action spécialisée pour l’enfant et la famille dans leur milieu de vie ( eurocef) : l’une concernant la suspension des allocations familiales en cas d’absentéisme scolaire, en application des lois du 28 septembre 2010 et du 24 mars 2011 (actuellement abrogées) ; et une autre, plus récente, montrant que la France ne remplit pas ses engagements à l’égard des mineurs étrangers non accompagnés séjournant sur son territoire. L’article ouvre la réflexion sur l’utilisation de la procédure des réclamations dans le domaine du travail social, par son secteur associatif. |

Summary, etc. | This article presents the substantial complementarity between legal solidarity and commitment solidarity through the example of the two collective complaints introduced in the framework of the Additional Protocol to the European Social Charter. The article shows the process by which the international non-governmental organisations ( ingos) bring the State policy into line with the Revised European Social Charter of the Council of Europe. Two presented examples focus on collective complaints addressed by the European Committee for Home-based Action for the Child and the Family in their environment ( eurocef): one concerning suspension of family allowances in case of school absenteeism, according to the laws of September 28, 2010 and March 24, 2011 (currently repealed) and another, more recent, showing that France does not fulfil its commitments with regard to unaccompanied foreign minors staying on its territory. The article opens the reflexion on the possible use of the complaints procedure in the field of social work by its civil society sector. |
