Un psychanalyste peut exercer sans rendre de compte à l’État, mais la plupart des thérapeutes travaillent avec l’agrément des caisses de maladies qui prennent en charge les soins, tout en exerçant un contrôle et en imposant des règles strictes au psychothérapeute, ce qui réduit la marge d’autonomie et d’initiative pour ceux qui acceptent ce statut. La loi promulguée en 1999 règle la reconnaissance des non-médecins; elle définit en détail les différentes étapes de formation et de probation pour accéder au titre de psychothérapeute. Cette législation relance la question posée par Freud à propos de «l’analyse profane»: comment la psychanalyse peut-elle résister à ce qui pourrait être une contractualisation réglementée, l’éloignant de sa vocation à être présente au «manque»? |

| Summary, etc. | Does Psychoanalysis Execute an Order? On the Law on Professional Psychotherapy in Germany. In German law, psychoanalysis implicitly belongs to the field of psycho-therapies. A psychoanalyst may practice analysis without having to account to the State, but most therapists first apply for accreditation by their local State Welfare Department who will then reimburse the costs incurred to the patient, but also oversee and impose strict rules and regulations on the psychotherapist concerned, thus considerably reducing his or her autonomy and room for initiative. The law published in 1999 determines the rules determining accreditation for psychotherapists who are not qualified Doctors – it lays down in detail the different qualifications that must be obtained and the practical experience necessary. This piece of legislation rekindles the question Freud sheds light on in his discussion of ‘lay analysis.’ By what means can psychoanalysis resist becoming contractualised and fully regulated, thus destroying its vocation to be operative in the dimension determined by ‘lack’. |
