| Summary, etc. | Fruit d’une construction sociale, la relation médecin-malade connaît aujourd’hui des mutations sensibles. La récente formulation d’un code des droits du malade et de la qualité du système de santé modifie le contexte et la nature de la décision médicale. Entre un modèle traditionnel de la décision faisant du malade un patient soumis au paternalisme médical et la crainte d’un malade devenu consommateur de soin, le malade a changé de statut. On interroge ici ce qu’il peut alors en être d’une décision médicale partagée, notamment dans un contexte marqué par une technicisation de la pratique médicale, une sécularisation des mœurs hospitalières et un individualisme démocratique. Les relations entre décision médicale et vulnérabilité opèrent ainsi comme le révélateur de la façon qu’a une société de prendre en compte l’homme malade. |

The changes of relationship between the doctor and his patientThe relationship between the doctor and his patient is a social building which is undergoing real changes nowadays. The recent writing of a law Code concerning the patient’s rights and the quality of the health system has generated a true upheaval in the context and the nature of every medical decision. Between a traditional model of medical decision making, in which the sick person is only a patient who has to undergo the medical paternalism and the fear generated by the fact that the patient looks like as a care consumer, the sick person’s statute has been modified. We would like to question about the sharing of medical decisions, in a context of high technicity of medical practising, secularism and democratic individualism. The relation between the making of medical decision and vulnerability also reveals the way our society really takes care of the sick. |

| Summary, etc. | La relación médico-enfermo, que es fruto de una construcción social, vive hoy mutaciones sensibles. Recientemente, la formulación de un código de derechos del enfermo y de la calidad del sistema de salud, ha modificado tanto el contexto como la naturaleza de la decisión médica. Entre un modelo tradicional de la decisión que transforma al enfermo en un paciente sometido al paternalismo médico, y el miedo a un enfermo que se ha transformado en consumidor de cuidados, el enfermo ha cambiado de estatuto. Aquí la cuestión radica en saber qué sucede luego de una decisión médica compartida, especialmente en un contexto que está marcado por una tecnicización de la práctica médica, por una secularización de las costumbres en los hospitales, y por un individualismo democrático. Las relaciones entre decisión médica y vulnerabilidad operan entonces como reveladores de la manera en que una sociedad toma en cuenta al hombre enfermo. |
