This article revisits common approaches that tend to assign a peculiar methodological stance to legal sociology in relationship to the externality to the law. The “necessity” to take a stand on this point is put into question, as it reveals a faith in the peculiar nature of law that is harmful to a proper sociological analysis. This is why we propose to defend a methodological neutrality towards law, in order to be able to eventually demonstrate, instead of presupposing, the social properties of law.
