L’arrêt de la Cour de cassation du 18 juin 2020 tend à gommer les incertitudes qui subsistaient sur la question de la charge de la preuve en matière d’obligation d’information du médecin. La présente contribution s’attache à rappeler le contenu de ces incertitudes, préciser en quoi l’arrêt commenté y répond, et celles qui demeurent. L’influence du nouveau droit de la preuve sur cette question est également abordée.

The judgment of the Court of Cassation of June 18, 2020 tends to erase the uncertainties that remained on the issue of the burden of proof in terms of the doctor’s obligation to inform. This contribution attempts to recall the content of those uncertainties, to specify how the commented judgment responds to them, and those that remain. The influence of the new law of evidence on this issue is also discussed.
