The article tries to explain the ethical nature of the action by the theory of punishment in Hegel. The justification of the penal act represents the first core of the dialectic which ‘‘ overtakes ’’the imperative of the statue law. By the justification of the penal act, Hegel exposes even the capital principle of hisidea of right : justice is possible only by recognition.
