After having distinguished the concept of “legitimate parental authority” from the one of “legal parental authority” in the psychoanalytical context of the family relationship, we will illustrate the importance of such a distinction when dealing with the comprehension of the institutional and interfamily violence process. Examples chosen among various psychoanalytical family therapies and socio-psychological situations will help us elucidate this distinction. We will then clarify the family secrets stakes facing both the relationship construction and the reference to the law among incestuous families.
