The index of legal certainty, or how to promote civil law through an indicator

The Index of Legal Certainty is an indicator issued by the Civil Law Initiative which is aimed at measuring legal certainty in various national legal systems. This indicator was created in reaction to the World Bank’s “Doing Business” reports, according to which common law systems are better for economic growth than continental systems. The article intends to describe its genesis, unveil the actors’ strategy, critically detail the way it is built and characterize the conception of legal certainty produced by the indicator. The article shows that the indicator does not measure legal certainty as such; rather, from the perspective of a foreign investor, it evaluates the presence of legal conditions deemed necessary for the safe and successful conduct of economic relations in a given legal order.
