Les nouveaux modes d’accès à la parentalité, qui multiplient les acteurs auprès de la venue au monde d’un enfant, brouillent nos représentations habituelles quant aux fondements des liens de filiation et d’appartenance familiale. De ce fait, la construction identitaire pour un enfant qui nait dans ces circonstances non ordinaires, dépend non seulement du positionnement des adultes qui remplissent la fonction parentale, mais aussi de la reconnaissance sociale et de l’appui qu’il peut trouver sur le système juridique. À travers la présentation du matériel clinique issu d’une rencontre clinique avec un homme gay devenu père dans des circonstances très complexes, cet article tente d’explorer différentes thématiques telles que : la question concernant le contre-transfert des thérapeutes qui accueillent les demandes d’aide des personnes concernées par ces problématiques ; la nécessité d’une articulation entre le point de vue juridique et psychologique afin de créer des repères plus solides quant à ces situations innovantes et déconcertantes.

The new modes of access to parenthood, by multiplying the actors involved in the birth of a child, blur our usual representations of the foundations of filiation and family belonging. In this context, the identity construction of a child born under such extraordinary circumstances depends not only on the position taken by the adults who assume the parental function, but also on the social recognition and legal support available to the child. Based on the presentation of clinical material collected during an encounter with a gay man who became a father under particularly complex circumstances, this article aims to explore several themes: the issue of countertransference among therapists who provide support to individuals concerned by these questions; the necessity of articulating legal and psychological perspectives in order to create more solid reference points for understanding these innovative and disconcerting situations.

De nieuwe vormen van toegang tot het ouderschap, die het aantal betrokkenen bij de komst van een kind vermenigvuldigen, vertroebelen onze gebruikelijke voorstellingen van de fundamenten van afstamming en familiale verbondenheid. In deze context hangt de identiteitsconstructie van een kind dat in zulke buitengewone omstandigheden geboren wordt niet alleen af van de positie die de volwassenen innemen die de ouderlijke functie vervullen, maar ook van de sociale erkenning en de juridische steun waarop het kind kan rekenen. Op basis van de presentatie van klinisch materiaal, verzameld tijdens een ontmoeting met een homoseksuele man die vader werd onder bijzonder complexe omstandigheden, wil dit artikel verschillende thema’s verkennen: de kwestie van overdracht en tegenoverdracht bij therapeuten die hulpvragen van deze personen opvangen; de noodzaak om juridische en psychologische perspectieven met elkaar te verbinden om stevigere referentiekaders te scheppen voor het begrijpen van deze vernieuwende en ontregelende situatie
