The Genesis of the Constitution of An VIII and Its Final Manuscript Modifications

This article gives an account of the genesis of the Constitution of An VIII and discusses the final manuscript modifications. It is arranged in a series of three documents.– The first part is an analysis dedicated to the circumstances surrounding the elaboration of the Constitution of An VIII. The introduction sets out the differences between the authentic draught of the Constitution (“minute”), which bears the French National Archive shelf mark AF/IV/991 (in a dossier entitled “Lois et actes du Corps législatif du Tribunat. An VII-1815”), the constitution kept in the French national Archive’s Armoire de Fer (“Iron Cabinet”) (AE/I/29/4), and the Constitution kept under the shelf mark AF/IV/I (entitled “Constitution de l’an VIII”). The chronological presentation was adopted to as to be able to give firstly an interpretation of Sieyès’s institutional views, probably circulated between 11 and 21 November, 1799, and then secondly to be able to analyse Daunou’s participation in the Constitutional project from 3 to 13 December.– The second part is a table of concordance showing each article in the text evolved through the different projects. This table is preceded by a short text presenting the source documents.– The final part comprises a literal transcription of the authentic draft (« minute ») of the Constitution of An VIII.
