The origins of the Quaestiones de juris subtilitatibus – a collection of theoretical “solutions” from the law of Justinian – have been the subject of much debate for a century; according to common opinion, the work was written in Italy. Using various arguments, especially one based on a passage from John of Salisbury’s Metalogicon, this paper attributes the Quaestiones to the Parisian master in dialectics Alberic de Monte, who wrote it probably some time between 1159 and 1168, after a stay in Bologna.
