Collective ownership, commons management, and social structures. The case of Peru

Par : Type de matériel : TexteTexteLangue : français Détails de publication : 2018. Sujet(s) : Ressources en ligne : Abrégé : Community is a very important institution in the rural areas of Peru, especially in the Andes. The common management of land is considered as one of its main features (Pajuelo, 2012). With the agrarian reform of 1969, these legally recognized communities received a collective property title for their land, which is a very important fact. Through the analysis of ethnographical data from the community of Llanchu (Calca, Cusco), this article shows how important this title has been for the formation and structuration of this community. Bearing in mind legal pluralism and its generative dimension (Le Roy, 2016), this work focuses on the transfer of the usufruct of irrigated plots. This reflexion aims at a better understanding of the link between commons management and the social structuration of the social group considered, thus underlining the importance of the legal status of commons.
