Environmental law theory

Par : Type de matériel : TexteTexteLangue : français Détails de publication : 2023. Sujet(s) : Ressources en ligne : Abrégé : The editorial staff of the RJE have decided to continue to explore environmental law theory, from the following perspective. It is a question of proposing elements of analysis that allow a "remote" interpretation of environmental law and its developments. To this effect, several sources will be drawn on, from classical legal theory to human and social sciences and philosophy. While classical legal theory looks at the law as a whole, here we focus specifically on environmental law. Its originality and history justify this choice. The following paper deals with two topics. Firstly, the recent sentences pronounced against the French state for its inaction concerning climate change and air protection, and, secondly, the current status of environmental law with regard to the law as a whole.
