Open banking is based on the principle of data portability. This principle provides freedom to the consumer of financial services in the management of their various transactions. However, this freedom requires greater responsibility from the various links in the chain. This responsibility, which once rested solely with the bank in its capacity as the principal depository, is extremely diffuse in an open banking system. This article aims to analyze the issues of determining liability and establishing an effective control system through the prism of agency theory.
