Public authorities allowed social partners to actively participate in the drawing up of labor laws by granting them the power of initiative. For a long time, the distribution of tasks between public authorities and social partners appeared relatively harmonious. However, in recent years, this cooperative process seems to have become more complex, and the two parties are now often in competition. This implies that some labor regulations are of poor quality. It would thus be useful to consider a regulating process that would avoid such consequences without depriving social partners of their power of initiative.
