Résumé L’histoire du barreau indien illustre les déterminants sociaux d’une étroite imbrication entre droit et politique – mais aussi ses aléas. Ainsi, la mobilisation du barreau contre l’état d’urgence instauré par Indira Gandhi n’a pas suffi à restaurer son crédit politique, gagné dans les luttes d’indépendance et perdu dans l’opposition aux réformes agraires. Par contre, en devenant le champion des plus défavorisés, la Cour suprême s’est imposée comme l’arbitre des joutes politiciennes. On peut y voir une division du travail symbolique dans le champ du pouvoir.

The story of the Indian bar illustrates the social factors determining the close intertwining of law and politics – as well as its ups and downs. Thus, the mobilisation of the bar against the state of emergency imposed by Indira Gandhi did not suffice to restore her political credit, earned during the struggle for independence and lost in her opposition to agrarian reforms. On the other hand, by becoming the champion of the disadvantaged, the Supreme Court emerged as the arbiter of political jousting. This can be seen as a symbolic division of labour in the field of power.
