Le droit connaît des institutions de l'oubli - grâce, amnistie, prescription. Mais nous voyons monter de la part des demandeurs de mémoire une attente, sinon une exigence, pour faire reculer l'oubli. C'était vrai, il y a peu, autour de l'imprescriptible et des lois mémorielles. Ça l'est également maintenant et singulièrement dans des affaires privées. Cette tension entre l'institution nécessaire de l'oubli pour pacifier l'espace commun et l'inacceptable oubli ressenti par la société, comment en rendre compte ? N'est-elle pas là le point de rencontre engageant une dialectique du signe et de la trace, du besoin d'effacement et d'obstination de l'ineffaçable ?

The law has its institutions for forgetting - pardons, amnesties, statutes of limitations. But we are now seeing, among those who insist on the duty of memory, an expectation, a demand even, that the tide of forgetting be turned back. This has been true in the recent past with the notion of imprescriptibility and historical memory laws. It is also the case now and singularly in private matters. But how can we account for this tension between the need to forget to pacify the common space, and the unacceptable forgetting perceived by society ? Is it not the point of convergence where a dialectic occurs between the sign and the trace, the need to wipe the slate clean and the obstinacy of indelibility ?
