La conception républicaine classique inscrit la Justice dans l'État, mission régalienne qui fait de la magistrature une fonction publique de nature particulière. La période 1918-1958 est marquée, dans les années trente comme à la Libération, par des projets d'émancipation de la magistrature vis-à-vis du politique sous des régimes parlementaires affaiblis par des affaires politico-financières, l'instabilité, puis les guerres de décolonisation. Si Vichy et la Libération ont instauré une justice d'exception, la création du CSM sous la IVe République a offert une opportunité d'émancipation des juges que l'appareil politico-administratif a neutralisée, avant que la Vème République ne rétablisse la prééminence d'un pouvoir exécutif fort exerçant sans partage ses prérogatives sur l'autorité judiciaire.

The classic conception of the French Republic places Justice within the State, with a sovereign role making the judiciary a specific public function. The period from 1918 to 1958 was marked in the 1930s and at the time of the Liberation by projects aimed at emancipating the judiciary from the political arena under parliamentary regimes sapped by political and financial scandals, instability and by the wars of decolonisation. While Vichy and the Liberation instigated an exceptional form of justice, the creation of the CSM (High Council of the Judiciary) under the 4th Republic brought an opportunity for the emancipation of judges, but one which was neutralised by the political and administrative machinery, before the 5th Republic restored the pre-eminence of a strong executive arm exercising its prerogatives unreservedly over the judiciary.
