Résumé Les réformes se font et se défont, ou, tout au moins, se redéfinissent, se réaménagent dans la pratique. L’histoire du Conseil supérieur de la magistrature sous la IVe République (1947-1958), écrite à partir d’archives inédites, révèle ainsi le processus de normalisation, à la fois politique, bureaucratique et corporatiste, subi par une institution novatrice s’attaquant aux rapports traditionnels de dépendance de la justice, comme à l’ensemble de la structure classique de l’État et au système hiérarchique de représentation du corps judiciaire. Ce processus complexe révèle les forces politiques et bureaucratico-judiciaires en jeu dans un champ judiciaire marqué par l’histoire et la concurrence.

Abstract Normalization of an Innovation : the Conseil supérieur de la magistrature in the 4th RepublicReforms are made and unmade, or, at the very least, redefined and reorganized in practice. The history of the Conseil supérieur de la magistrature during the 4th Republic (1947-1958), written on the basis of new archives, reveals the process of political, bureaucratic, and corporatist normalization sustained by an innovative institution tackling traditional judicial relations of dependence, as well as the classic structure of the State and the hierarchic system of representation of the judiciary corps. This complex process reveals the political and bureaucratic-legal forces in play in a legal field marked by history and competition.
