The judge and fundamental values: creating an ethics of discussion

Judges are responsible for ensuring respect for a certain number of fundamental values, but these values are liable to change and come into conflict with each other. Only a decision-making process based on discussion and meeting strict methodological conditions can give legitimacy to the choices they make. This process is inspired by a “pragmatic natural law” which is bound to an ethics of discussion by an “open interactive procedure” advocated by the author.
