En s’inspirant d’une conception normative de la Constitution qui tient compte du critère d’effectivité, on aborde le sujet de l’évolution de l’État (social) et des ordonnances européennes, avec une attention spéciale aux droits (en particulier, sociaux) et les effets que la crise économique a produits dans ceux-ci. Après une analyse des origines (lointaines) et de l’évolution (plus récente) des droits fondamentaux dans le droit originaire de l’Union Européenne (article 6 du TUE et de la Charte des Droits fondamentaux de l’UE), l’article aborde la problématique projetée par la protection dispensée aux droits sociaux européens depuis la nouvelle optique du constitutionnalisme multiniveau (article 151 du TFUE et article 53 de la Charte des Droits), en mettant en évidence les limites de la primauté répandue

Inspired by a ‘normative’ conception of the Constitution and attentive to the criterion of effectiveness, this analysis deals with the evolution of the (social) state and European rights with particular regard to rights (especially social) and to the effects produced on them by the economic crisis. After an analysis of the origins and evolution of fundamental rights in the primary law of the European Union (Article 6 of the TEU and the Charter of Fundamental Rights of the EU), the contribution addresses the problems posed by the protection accorded to European social rights in the new perspective of multilevel constitutionalism (Article 151 of the TFEU and Article 53 of the Charter of Rights), highlighting, in this context, the limitations of the argument about the generalized primacy of EU law with respect to those same constitutional provisions in terms of principles and fundamental (social, but not only) rights. With this in mind, in the final part, the analysis focuses on issues of effectiveness of social rights in light of the effects of the regression produced on them by the economic crisis.
