Nous examinons le consentement du mariage et la liberté des époux. À partir d’une étude des jugements de nullité de mariage, nous tentons de comprendre l’interprétation des juges de la notion de contrainte physique et morale. Nous analysons les conséquences des unions forcées : sentiment de honte, atteinte de la subjectivité mais aussi le traumatisme et les possibilités de résilience.

Forced marriage, physical violence, moral violence, a thinking on judgments in the annulment of marriageWe examined the consent of marriage and the freedom of husband and wife. From a study of judgments in the annulment of marriage, we tried to understand the interpretation of judges on the notion of physical and moral constraint. We analysed the consequences of forced unions : feelings of shame, the inability to be subjective and also the trauma and the possibility of resilience.
